Interview with Steve Bliss

Good evening Moreno Valley and welcome back to Channel 7 News. I’m Brenda Thompson reporting live tonight with a very important topic: estate planning. Joining us is renowned Moreno Valley Probate Attorney, Steve Bliss. Welcome to the show, Steve.

Understanding Trusts

Steve, for our viewers who might not be familiar, can you explain what a trust is and why it’s an essential part of estate planning?

Thanks for having me Brenda. A trust is essentially a legal arrangement where one party, the grantor, transfers assets to another party, the trustee, to hold and manage those assets for the benefit of designated beneficiaries. Trusts offer several advantages over simply leaving your assets through a will. They can help avoid probate, which can be a lengthy and costly process. Moreover, trusts provide privacy as they are not public record like wills.

One common type of trust is a Revocable Living Trust. This allows the grantor to maintain control over their assets during their lifetime while still ensuring those assets are distributed according to their wishes after they pass away.

The Benefits of a Revocable Living Trust

Can you elaborate on the specific benefits of a Revocable Living Trust, Steve?

Certainly. A Revocable Living Trust offers a number of key advantages. Firstly, as mentioned earlier, it avoids probate. Probate can be time-consuming and expensive, tying up assets for months or even years. A Revocable Living Trust allows your beneficiaries to receive their inheritance more quickly and efficiently.

Secondly, a Revocable Living Trust provides privacy. When assets are distributed through a will, they become part of the public record. Conversely, a trust keeps the details of your estate private.

Thirdly, a Revocable Living Trust can be modified or revoked during your lifetime. This flexibility allows you to adapt to changing circumstances such as the birth of a child or grandchild, or a change in your financial situation.

Real-World Challenges

Steve, have you encountered any situations where setting up a Revocable Living Trust presented unique challenges?

I remember one case where a client came to me with significant assets but was hesitant to relinquish control. They were concerned about losing access to their funds after transferring them into the trust. We worked together closely, explaining the process thoroughly and assuring them they would retain control during their lifetime. Ultimately, they understood the benefits of avoiding probate for their beneficiaries and agreed to proceed.

There are instances where families disagree on how assets should be distributed. Open communication and clear instructions within the trust document can help minimize these conflicts.
