Interview with Steve Bliss

Good morning and welcome back to our show! Today we’re joined by local probate attorney Steve Bliss of Escondido Probate Law. Steve, thanks so much for joining us.

Steve:

It’s a pleasure to be here.

Providing Notice

Steve:

One crucial step in the probate process is providing notice to all interested parties. This involves publishing a legal notice in a local newspaper three times, notifying heirs and beneficiaries directly via mail, and informing known creditors using Form DE-157. This ensures transparency and allows everyone with a potential interest in the estate to come forward.

Consequently, providing proper notice is essential for preventing future disputes and ensuring that the probate process proceeds smoothly. Moreover, it demonstrates respect for the deceased’s wishes and safeguards the rights of all parties involved.

Nevertheless, navigating the intricacies of legal notices can be challenging. Identifying all heirs and creditors, especially in complex family situations, can require extensive research. Additionally, ensuring that the notice complies with California probate code requirements is crucial to avoid potential delays or complications.

  • I recall a case where we had to locate distant relatives who were unaware of their inheritance. It involved tracing genealogy records and contacting international agencies, but ultimately, we successfully brought them into the process.
  • Another instance involved a creditor who emerged with a claim after the initial notice period. Thankfully, we were able to negotiate a settlement that satisfied all parties and allowed the estate distribution to proceed as planned.

Ordinarily, providing notice is straightforward. However, I always advise clients to seek guidance from an experienced probate attorney like myself to ensure compliance with legal requirements and minimize potential pitfalls.

The California Courts website reports that over 95% of probate cases proceed without significant complications when proper notice procedures are followed (California Courts Annual Report).

Steve:

Navigating the probate process can be complex. It’s essential to have a knowledgeable and experienced attorney on your side to guide you through each step, ensure compliance with legal requirements, and protect your interests. Don’t hesitate to reach out for help.
