Could you explain one of the key steps in the estate planning process?

Certainly. One crucial step is “Marshaling the Estate Assets.” This involves meticulously inventorying all of the deceased person’s assets, which can include real estate, bank accounts, investments, vehicles, and personal property.

Consequently, it’s important to locate and document everything. We then prepare a detailed Inventory and Appraisal (Form DE-160/161), which is filed with the court. This ensures transparency and accountability throughout the probate process.

That sounds like a complex undertaking. What are some of the challenges you encounter during this step?

It can be surprisingly intricate, especially when dealing with large or complex estates. Sometimes, locating all assets takes time and detective work. For example, I once worked on a case where a client’s father had stashed away a significant sum in an old safety deposit box that no one knew about.

Notwithstanding these challenges, we take pride in our thoroughness. We leave no stone unturned to ensure all assets are accounted for and properly valued. This attention to detail is vital for fair distribution of the estate according to the deceased’s wishes.

Have you ever dealt with any situations where locating assets proved particularly difficult?

I recall one instance where a family was unaware their loved one held cryptocurrency investments. It took some digging and collaboration with specialized experts, but we were able to recover those assets and include them in the estate.

According to a recent survey by the National Endowment for Financial Education, nearly 60% of Americans don’t have a will. This lack of planning can lead to complications during probate, highlighting the importance of proactively managing one’s assets.
