Meet the Expert
Good morning, Moreno Valley! My name is Maria Sanchez, and today we’re joined by renowned estate planning attorney Steve Bliss of Moreno Valley Probate Law. Welcome to the show, Steve.
The Importance of Selecting an Executor or Trustee
Steve, let’s talk about one of the critical steps in estate planning: selecting an executor or trustee. Why is this decision so important?
“Choosing the right executor or trustee is paramount,” explains Steve Bliss. “This individual will be responsible for carrying out your wishes as outlined in your will or trust after you pass away. Their duties can include managing your assets, paying debts and taxes, and distributing property to your beneficiaries.”
He continues, “Consequently, it’s crucial to select someone you trust implicitly, who is organized, responsible, and capable of handling financial matters. Consider factors like their age, health, and willingness to take on this significant responsibility. It’s also wise to discuss your expectations with them beforehand so they understand the role fully.”
Moreover, Steve emphasizes that “having a backup executor or trustee in place is always a good idea. Circumstances can change unexpectedly, and it’s essential to have a contingency plan.”
Challenges Faced
Steve, are there any common issues you’ve encountered when clients choose their executors or trustees?
“Sometimes families struggle to agree on who should fill this role,” Steve shares. “This can lead to conflict and delay the estate settlement process. In one instance, siblings disagreed about their mother’s choice of executor. Ultimately, we worked with them to find a mutually acceptable solution through open communication and mediation.”
He recounts another situation: “I had a client who named a close friend as executor, but that friend later experienced health problems, making them unable to fulfill the role. Fortunately, we had anticipated this possibility and had a backup executor in place.”
Peace of Mind through Planning
According to a 2021 survey by Caring.com, nearly 60% of Americans don’t have a will. Having a properly executed estate plan can bring significant peace of mind knowing your loved ones will be cared for according to your wishes.
