Introduction
Hello and welcome back to San Diego Legal News. Today, we are joined by Steve Bliss, a prominent San Diego Probate Attorney with extensive experience in estate planning. Steve, thank you for taking the time to speak with us today.
Testamentary Trusts Explained
Steve, many of our viewers may be unfamiliar with testamentary trusts. Could you explain what they are and how they differ from other types of trusts?
A testamentary trust is a trust that is created through a will and only comes into effect upon the grantor’s death. Consequently, unlike living trusts, testamentary trusts go through probate. They are often used for specific purposes, such as providing for minor children or beneficiaries with special needs.
Benefits of Testamentary Trusts
What are some of the key benefits of using a testamentary trust?
Testamentary trusts offer several advantages. Firstly, they provide a structured way to manage assets for beneficiaries who may not be capable of managing them on their own. For instance, a parent might establish a testamentary trust for a child with disabilities to ensure their long-term financial well-being.
Moreover, testamentary trusts can help minimize estate taxes in some cases. They also allow the grantor to specify exactly how and when assets are distributed to beneficiaries.
Challenges and Considerations
Are there any potential drawbacks or challenges associated with testamentary trusts?
While testamentary trusts are valuable tools, it’s important to remember that they go through probate. This means the trust administration process is public record, unlike living trusts. Probate can also be time-consuming and costly.
I recall one case where a client had established a testamentary trust for their grandchildren. Unfortunately, due to family disputes, the probate process became lengthy and contentious, resulting in significant legal fees. This highlights the importance of carefully considering all aspects before opting for a testamentary trust.
